    Subject to exclusions or as otherwise indicated all goods supplied by Clutch and Brake Australia (CBA) are warranted against defects in design, manufacture and workmanship for a period of 12 months from Date of Fitment or 20,000 km, whichever occurs first. The benefits given under this warranty are in addition to the other rights and remedies available to you under the Australian Consumer Law and/or other laws. In accordance with the above statement the following may exclude products presented for warranty: 1. Any goods described, either written or implied, as performance or for use in motorsport, racing, off-roading and/or time trials are not covered by this warranty unless the product is specifically designed for that activity. 2. Where vehicles are fitted outside of the original specification (i.e. conversions & high performance) the warranty will not apply to the following: shudder, slip, different pedal feel, harsh engagement, maltreatment, damage caused by collision or incorrect fitting of the part. 3. Where a defect has been the result of mistreatment of the vehicle or component. 4. Where a defect has been the result of incorrect handling, misalignment, use or fitment of the component. 5. Where goods are fitted to modified vehicles and/or modified to Heavy Duty Specifications and/or any other specification and/or non original conversions. 6. Where goods have been fitted to incorrect or unlisted applications. 7. In the event of a failure of which the purchaser believes to be warrantable all components must be returned to CBA within 30 days of said failure. 8. CBA will not accept any goods for warranty that have been modified or repaired unless by prior authorisation from CBA. 9. No products will be accepted as warranty until the items have been inspected and found faulty by CBA or a CBA appointed third party. It is the responsibility of the supplier to return any products considered by the purchaser to be faulty to CBA. Any claim for additional expenses including labour must be included with a completed Warranty Claim Form. These claims must be substantiated with clear documentation such as a workshop invoice. Should the warranty be approved these additional expenses will be assessed by CBA. As of January 2014, CBA will apply a maximum rate of $55 per hour excluding GST based on time deemed fair and reasonable by CBA to remove and replace the warrantable component concerned. In the event that a product is found not to be warrantable the expense of claiming under this warranty shall be borne by the Purchaser. CBAÂ’s liability does not extend to any indirect or inconsequential losses incurred by the Supplier or the Purchaser. It is the RepairerÂ’s responsibility to ensure all new components compare in function and dimensions to the replaced components and are correct for the application. While all care will be taken to supply the correct goods the correct selection of products is the responsibility of the Purchaser.
